This model release is made by ____________________________, an individual (the “Model”), in favor of America First Policy Institute (“AFPI”). In consideration for AFPI publicly advocating for public policy solutions, the Model agrees as follows: 

1. PERMISSION TO TAKE AND USE TESTIMONIALS. 

(a) Permission to Use. The Model grants AFPI the full irrevocable right to edit, copy, exhibit, publish or distribute the Testimonial for any lawful purpose. The Testimonial contents may be used in printed publications, multimedia presentations, on websites or in any other distribution media, in whole or in part.  

(b) No Obligation. AFPI’s right to use the Testimonial does not constitute an obligation to make use of this right. 

(c) Partner Use. AFPI has existing and future data sharing relationships with partner organizations (“Partners”). At AFPI’s sole discretion, the Testimonial may be shared with Partners for use in activities aligned with AFPI’s mission. The permissions granted by the Model to AFPI in subsection (a) shall apply equally to AFPI’s Partners. 

2. ASSIGNMENT; WAIVER. 

The Model assigns to AFPI all interest in the Testimonial, including copyright. The Testimonial and any associated files are the sole property of AFPI and the Model waives any right to: 

(a) inspect or approve the Testimonial; 

(b) inspect or approve any text, graphics, images or other content created in connection with or combined with the Testimonial; or 

(c) receive any royalties or other compensation related to Testimonial use. 

3. RELEASE. 

The model hereby releases AFPI from any liability arising from Testimonial use, including that based on copyright infringement, invasion of privacy, right of publicity, libel, defamation, or false light, or resulting from any alteration, blurring, optical illusion, use in composite form, distortion, or other modification that may occur, intentionally or otherwise, in connection with taking the Images, processing the Images or the Testimonial  use. 

4. MODEL’S REPRESENTATIONS. 

The Model hereby represents that: 

(a) he or she is a legal adult and has the full legal capacity to execute this release, or a lawful parent or guardian is signing the release on behalf of a minor; and 

(b) the rights granted under this release do not conflict with or violate any other commitment the Model has; and 

(c) he or she has read this release before signing it and fully understands its contents, meaning and impact. 

The Model or lawful parent or guardian is signing this release on the date stated opposite his or her signature.
